College Student Disciplinary Defense

We represent college students accused of academic misconduct, code of conduct violations, or criminal offenses on or off campus. We guide students and their families through these high-stakes proceedings, protecting their rights and ensuring due process in a system that often feels stacked against them.

When a student is accused of wrongdoing at college, everything they’ve worked for is suddenly at risk. A single allegation—whether it involves cheating, misconduct, assault or other criminal offense—can lead to suspension, expulsion, and a permanent stain on their academic record. These consequences can derail not only their education, but their future, from graduating to starting a career.

In order to comply with Title IX’s mandate to prohibit sex-based discrimination and ensure equal access to educational programs and activities, colleges have developed very robust disciplinary processes and grievance procedures and requirements for investigations and hearings. However, these hearings often feel far from fair. Unlike a courtroom in a city or municipality, campus disciplinary systems are private, tightly controlled, and lack some of the protections for citizens found in the mainstream legal system. In many cases, they operate with little transparency—and the student can feel like the outcome is decided before the hearing even begins.

Unfortunately, false accusations do happen. And too often, schools are more focused on protecting themselves than on protecting the rights of the accused. Students may be treated as if they’re guilty from the start, without a fair chance to defend themselves.

While Pennsylvania schools can sometimes limit the role an attorney can play, that doesn’t mean you need to try to defend yourself. We can provide invaluable counsel, guidance, and advocacy at key points during the investigation and proceedings. We can provide support at every step of the way, including:

  • Review of documents, evidence, and school policies
  • Help prepare for interviews and hearings
  • Build a strong defense strategy
  • Identify and prepare witnesses
  • Draft cross-examination questions
  • Ensure due process is followed
  • Assist with appeals if needed

At McMonagle Perri, we will fight to protect a student’s rights, reputation, and future.
